Order handling
When placing an order, you must provide data necessary for its fulfillment, i.e., email address, your personal details, and invoice information.

Each order is recorded in the database, therefore, along with your personal data assigned to the order, information regarding the order is also stored, such as the date and time the order form was sent, order identification number, transaction ID, order subject, price, method, and time of payment.

Data collected through the Order Form are processed and/or stored for order fulfillment and processes necessary to conclude the sales agreement based on Article 6(1)(b) GDPR, including issuing a sales document under Article 6(1)(c) GDPR; accounting for the invoice as part of statutory tax and accounting obligations for settlements and bookkeeping under Article 6(1)(c) GDPR; initiation of proceedings related to potential claims or necessity to defend against claims under Article 6(1)(f) GDPR.

Personal data provided in the order form along with information about order details are processed and stored for the period necessary to fulfill the order, until the expiry of the limitation period for claims under the contract (2 years from the last day of the calendar year in which the claim arose, or 6 years for asset claims and court-certified claims under the Civil Code), and as required by tax law and the accounting act for the obligation to maintain accounting documentation, as well as until consent is withdrawn or an objection to the processing of personal data is filed as part of the Administrator’s legitimate interest under Article 6(1)(f) GDPR.

Correspondence handling
When you contact us via email or the contact form, you naturally provide personal data such as your name and surname, email address, and, in the case of email (for logged-in Google account users), also your profile photo.

Providing data in incoming correspondence is based on your will and voluntary decision; therefore, it is based on the premise set out in Article 6(1)(a) GDPR under presumed consent for processing information.

In outgoing correspondence for which you are the recipient, your data is processed to establish contact with you in the legitimate interest of the Administrator (myself) under Article 6(1)(f) GDPR.

The content of both incoming and outgoing correspondence is archived for 6 years due to the legitimate interest of the Administrator under Article 6(1)(f) GDPR, to ensure the option to demonstrate certain facts and decisions in the future, in connection with potential claims or debt collection.

As such, you retain the right to obtain a copy of the correspondence history, as well as to request its deletion if archiving correspondence is no longer justified due to overriding interests of the Administrator, e.g., in connection with defense against potential claims from your side.

Detailed information regarding the processing of personal data for correspondence purposes has been prepared in a separate document titled “Privacy Policy for Correspondence.”

Social media
When following our company profile “Pracownia Techniki Dentystycznej” on Facebook or interacting with our content published on social media, you naturally provide data that is public on your social media profile. Such data is processed with our involvement only within the respective social media platform and solely for the purpose of managing the business account, which we solely own and administer in accordance with Article 6(1)(f) GDPR in the legitimate interest of the Administrator (ours).

Your presence and activity on social media are subject to the regulations and privacy policies of the administrators of those platforms. This directly means that the gathered personal data can be used for their own business and marketing purposes.

Therefore, we recommend always making a careful selection of the forms of communication and accompanying content, as well as managing privacy settings rationally for conscious use of social media and protection of your privacy within them.

At this point, we also invite you to read the document “Privacy Policy for Fanpage/Business Account on Facebook.”

Tax and accounting obligations
When ordering, you must provide invoice data that enables the transaction and the fulfillment of obligations between the parties to the extent necessary to perform the contract (including processing payments and, on this basis, delivering the prosthetic work).

For a traditional invoice, for a sole trader, it is required to provide the business name, registered address, and NIP. For an individual invoice (for natural persons), your personal details (name and surname) and residential address are required.

The sales document in the form of an individual invoice or business invoice forms part of the company and tax documentation, which must be stored for 5 years from the end of the calendar year in which the tax payment deadline occurred. Accordingly, your personal data are processed in order to fulfill our tax and accounting obligations for the period required by tax regulations and the accounting act under Article 6(1)(c) GDPR.

Analysis and statistics
Implemented on this site, tools such as Google Analytics or Meta Pixel (formerly Facebook Pixel), automatically collect information about the operating system and web browser, visited subpages, viewing specific site/subpage content, time spent on the site and specific subpages, approximate geolocation of the user, events and reactions, filling in a certain form (e.g., contact form), interactions with videos, file downloads, etc.

This information, also referred to as anonymous data, is not related to specific individuals using the site and is not used for identification purposes. The Administrator uses it only to compile statistics to support ongoing operational and administrative activities for improving the site’s architecture, functionality, and content. Anonymous data are processed for the legitimate interest of the Administrator under Article 6(1)(c) GDPR until the purpose for processing is achieved in connection with data becoming obsolete or losing analytical and informational value. The legitimate interest is optimizing the website to improve the quality and user experience.

Due to the main physical characteristic of this data—which is anonymity—and the inability to match the information held to a profile or specific user, we cannot provide you access to information about yourself, obtain a copy, or correct it. You may, however, object to the collection and processing of anonymous data by deactivating Google Analytics and Facebook Custom Audiences cookies via the cookies settings panel, accessible by clicking the appropriate link in the site footer.

Detailed information about the Google Analytics solution can be found in the section dedicated to this tool as part of the cookies policy here, and about the Meta Pixel (formerly Facebook Pixel) here.

Document archiving
We have assigned specific data archiving periods to each of the aforementioned data processing purposes.

Document archiving constitutes a legitimate interest of the Administrator under Article 6(1)(f) GDPR to ensure the ability to prove specific facts and reasons in the future, to reconstruct the course of a purchase transaction and/or scope of cooperation based on the documented history of incoming and outgoing correspondence, in connection with potential claims or the necessity to defend against claims or debt collection.

Does the administrator process personal data based on consent?
In the operation of this site and Pracownia Techniki Dentystycznej Maciej Nytko company, it may occur that data are processed based on written user/client consent under Article 6(1)(a) GDPR. Data processing based on consent will occur in certain situations, especially for marketing purposes. However, processing for marketing purposes does not include processing directly for business purposes. This particularly refers to the use and dissemination of a personal image and identity in publishing testimonials or before-and-after results of treatment involving the laboratory, to the extent and in the manner provided in the relevant document’s provisions.

In such a case, the Administrator will ask you to provide consent/declaration of will in writing or by explicit action, including checking a box in an electronic form or IT system, next to the related consent content. The data processed on this basis will be stored and used until the consent for processing is withdrawn.

At the moment of obtaining consent, you will be informed about the rights you have as a data subject (as required under the GDPR), as well as be informed of the consequences of withholding consent for processing in the scope described in the clause, with particular attention to the fact that this will not affect the ability to provide or the quality of certain services.

How long are data processed/stored?
Detailed information about data retention periods is specified separately in the sections dedicated to each of the discussed processing purposes here.

Personal data will be collected and processed for the period necessary for the realization of particular processing purposes or until an objection is raised if the basis for processing is the legitimate interest of the Administrator or until consent is withdrawn if the basis for processing is a statement of consent. The Administrator may store personal data until the limitation period for potential claims expires or the data storage obligation ceases under legal regulations (including tax and accounting regulations).

Who are the recipients of my personal data?
The Administrator shares personal data with, e.g., courts, prosecutor’s offices, tax offices, police services, and other state authorities and institutions in connection with their proceedings, upon their request, after meeting the conditions for mandatory disclosure or within the framework of obligations resulting from applicable law. In the case of an inspection by the President of the Personal Data Protection Office, personal data may be made available to Inspectorate employees in accordance with the Personal Data Protection Act.

Personal data may be entrusted to subcontractors whose services the Administrator uses in fulfilling its statutory obligations and to external entities carrying out tasks on the instruction and in the name of the Administrator under personal data processing agreements, such as IT system administration, servicing of invoicing software, accounting services, legal services, and others supporting the daily operations of Pracownia Techniki Dentystycznej Maciej Nytko.

The entities entrusted with your personal data by the Administrator guarantee to fulfill responsibilities imposed by the GDPR and thus apply appropriate measures for the protection and security of your personal data.

The Administrator does not transfer, sell, or share collected personal data with unauthorized individuals or business entities.

Due to using service providers who store data on American servers (Google, Facebook, and Zoom Video Communications, Inc.), the Administrator may transfer your personal data to countries outside the European Economic Area (EEA). However, the aforementioned service providers participate in the Data Privacy Framework program (formerly Privacy Shield), ensuring an appropriate level of protection for personal data compliant with European regulations and the GDPR to secure your data.

Are personal data processed automatically?
Your personal data may be processed automatically (including in the form of profiling); however, this will not have any legal effect on you or similarly significantly affect your situation.

Profiling of personal data by the Administrator consists of processing your data (including automated processing) for the purpose of evaluating certain information, in the process of analyzing or predicting individual preferences and interests.

Profiling will never be used to apply discriminatory policies, e.g., pricing based on displaying higher prices to users profiled as wealthy.

Are my personal data secure?
The security of personal data is a priority for us, which is why as the Administrator we have taken appropriate protection measures to secure the personal data of clients and users of this site.

Your personal data, collected in the Administrator’s databases, are processed, stored, and protected with due diligence as part of our Personal Data Security Policy, in accordance with applicable law and GDPR requirements, to secure them against unauthorized persons, loss, damage, destruction, unjustified modification, unauthorized interference, and against unlawful processing.

The Administrator’s databases are maintained on a device with very limited third-party access and protected by a multi-factor user verification system. Copies of the Administrator’s database are kept on a dedicated external SSL drive in a location protected by a key and access code system, with extremely limited third-party access.

The www.mmnytko.pl website is protected by the SSL network protocol used for secure internet connections. The SSL certificate ensures the confidentiality and integrity of data transmitted over the internet, as all
connections and data transfers between the
user (web browser used) and the FTP server hosting the site are fully encrypted and thus protected.

SSL-secured communication guarantees the user site protection for information provided via HTML forms and personal and sensitive data, such as address/delivery address, logins and passwords, payment card data, bank accounts, etc., making electronic banking transactions fully secure.

A website with an SSL certificate is marked in the browser address bar with a closed padlock icon symbolizing security and the https:// (Hyper Text Transfer Protocol Secure) prefix instead of the standard http:/ before the URL.

The Administrator does not transfer, sell, or share collected personal data with unauthorized individuals or business entities.

Within the limits specified by law, you have the right to:

   a | access your personal data and information about what data I hold and obtain a copy;

What are cookies?
Cookies are small text or numeric files, saved and stored in the IT system on your end device (e.g., computer, tablet, smartphone, or any other device used to connect to the service) while browsing websites. Cookies typically contain
basic info about the website they come from, the “lifetime” of the cookie, i.e., how long it is stored on the device, and a randomly generated unique number to identify the browser connecting to the site. Cookies store and keep certain info that can be read by my IT system (own cookies) or by third-party IT systems (third-party cookies).

On what basis do I use cookies?
Cookies are used with your consent. Your consent is expressed through appropriate software settings, especially your web browser installed on the telecommunications device you use to browse the Internet.

Cookies not necessary for proper electronic service provision remain blocked until you declare consent for their use.

We also provide a tool allowing you to manage cookies and decide which you consent to and which you want to block. You will find this tool here. However, note that disabling all or selected cookies may limit functionality or effectively prevent some solutions on my website from working properly and may cause difficulties in using this site, as well as many other websites using cookies. In extreme cases, this operation may block correct page display.

Why does the Administrator use cookies?
The main purpose of the Administrator’s use of cookies is to manage the site and improve its architecture and content to enhance user experience. Cookies are necessary for the site to display and function correctly, recognize a user’s device to optimize the site layout and tailor its content to user preferences. Own cookies are used to ensure the correct functioning of site mechanisms, such as remembering the cart contents after adding selected products, correct form submissions on the site, etc. Information about your defined cookie settings from the cookies management tool is also stored in own cookies.

The Administrator may also process information contained in cookies to collect statistical data and conduct anonymous research and analysis to help understand how users use the site (third-party cookies, e.g., Google Analytics, serve this purpose).
Cookies are not used to identify site users.

What types of cookies are used on the site?
The Administrator actively uses the following types of cookies:
   a | session cookies, which are temporary files, stored on the user’s end device while using the service and automatically deleted after logging out, leaving the site, or closing the browser;
   b | persistent cookies, which make it possible to identify the browser upon your next visit and are stored on the user’s end device for a period defined in the cookie parameters or until deleted by the user;
   c | own cookies created and provided by my site’s domain;
d | third-party cookies originating from other domains, e.g., Google, Facebook, YouTube.

Some cookies we use are deleted after the browser session ends, i.e., after it is closed (so-called session cookies). Others remain on your end device and enable the recognition of your browser during future site visits (persistent cookies).

What tools does the Administrator use?

Meta Pixel (Facebook Pixel)
The Administrator uses the Meta Pixel (formerly Facebook Pixel) from the Meta Business Suite (formerly Facebook Business Suite), provided by the Facebook social platform, to manage the site, collect statistical data, analyze user behavior, and improve its architecture and content for better quality and user experience (on the basis of legitimate interest).

To use this tool, special code—the Facebook Pixel—supporting cookies has been implemented in the site code. Facebook Pixel automatically saves information about:
a | viewing the content of a specific page,
b | time spent on the site and its subpages,
c | events and reactions, e.g., video views,
d | completion of a particular form, e.g., contact form.

The collected data are transmitted and stored on Facebook servers, which may be located worldwide, especially in the United States of America (USA).

The data obtained through Facebook Pixel is not associated by us with specific persons using the site and is not used for your identification. However, Facebook may combine the collected data with other data it collects about you when using the service and use it for its own business and marketing purposes.

Detailed information about the purposes, scope of data collection, and the ways data is processed is described in the Facebook privacy policy.

Google Analytics
The Administrator uses the Google Analytics tool provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA to manage the site, collect statistics, analyze user behavior, and improve architecture and content for better quality and user experience (based on legitimate interest).

To use Google Analytics, special Google Analytics tracking code, supporting Google LLC cookies, has been implemented in the site code. Google Analytics automatically saves information about:
a | operating system and web browser,
   b | visited subpages,
c | time spent on the site and its subpages,
   d | transitions between subpages,
e | the source from which you enter the site,
   f | approximate geolocation.
It also registers events and reactions, such as website views, video and form interactions, and file downloads, serving to prepare session statistics.

The collected data are transmitted and stored on Google LLC servers. They are not associated with specific persons using the site and are not used to identify you.

Because IP anonymization is activated, your IP address is truncated before being transmitted further and—in principle—is not combined with other Google data.

Google Analytics and Google Analytics 360 services have independently received certification under ISO 27001, one of the world’s most recognized information security standards, objectively confirming that Google Analytics and Google Analytics 360 information management systems meet the strict requirements of international standards.

Detailed information about the purposes, scope of data collection, and processing methods can be found in the Facebook privacy policy.

YouTube
The Administrator uses embedded YouTube widgets enabling users to play video content from YouTube directly on my site. The YouTube platform is operated by Google LLC.

Videos published on the site are embedded in privacy-enhanced mode. This means that no cookies will be saved on your end device, and data is not collected on Google LLC servers until you take relevant action and play the video.

When you play a video, YouTube saves cookies on your device and receives information about the site from which you watch the video, even if you do not have an active YouTube account and are not logged into the browser. If you are logged in to a Google account, you allow the service provider to directly link your site visit to your profile. If you do not want Google to associate the data gathered from video playback directly to your profile, you should log out before starting the video. Data collected through cookies related to YouTube videos embedded on my site are used by Google LLC to ensure correct and safe widget operation, to analyze and optimize YouTube services, and for personalization and targeted advertising.

Detailed information about the purposes, scope of data collection, and processing methods is described in the YouTube privacy policy.

Anti-plagiarism program
To protect intellectual property, the Administrator uses an anti-plagiarism program, which, through controlled monitoring of internet resources, detects abuses associated with the illegal distribution of materials.

The program continuously analyzes copyright-protected content and verifies its presence in other sources using Google search.

The program does not collect or process any site user data, nor does it match any data with users or identify them.

How do I change settings or disable cookies?
Most browsers by default accept the saving of cookies. You can freely manage and configure cookie settings according to needs and personal preferences, e.g., completely withdraw previously granted consent or change the scope of cookie use and delete them from your browser. At any time, you can restrict or disable cookies in your browser by setting it to block cookies or warn you before saving a file on your device. You can also block cookies from specific websites.
However, remember that disabling all or selected cookies may limit or prevent some solutions available on my site from functioning correctly and may cause difficulties in using this site, as well as many other websites using cookies. In extreme cases, this operation may block the correct display of the site.

Alternatively, you can use your web browser’s incognito mode if you do not want information about visited websites and downloaded files to be saved in your browsing history and the internal memory of your device. Cookies created in incognito mode are deleted when all browser windows are closed.

Below you will find a list of privacy management options and dedicated tools:
   a | browser-level cookie settings,
b | browser plugins supporting cookies management, e.g., Ghostery,
c | additional software for cookies control available in antivirus software packages,
d | incognito mode in your browser,
e | service supporting behavioral advertising settings management, e.g., youronlinechoices.com,
f | a cookies management tool available directly on my website here,
   g | Google Analytics Opt-out,
   h | Facebook Ads Settings.

What are server logs?
Using the service involves sending queries to the server hosting this website. Each query sent to the server is recorded in server logs. The logs include, among others, your IP address, server date and time, information about the web browser and operating system you use. Logs are saved and stored on the server. Data saved in server logs are not associated with specific persons using the site and are not used by me for your identification. The server logs serve only as auxiliary material for site administration, and their contents are not disclosed to anyone besides individuals authorized to administer the server.

Is there anything else I should know?
